What Travel Operators Need to Know: Legal & Regulatory Trends Unpacked

by | May 23, 2025

Reflections from our recent Risk, Safety and Crisis Management Seminar.

Over the coming days and weeks we’ll be sharing insights and our key takeaways from our recent Risk, Safety and Crisis Management seminar.

We were delighted to have Claire Mulligan, Partner at Kennedys, as our first speaker at the seminar and who delivered a thought-provoking legal and regulatory update for businesses across the tourism and travel sector. Claire, a recognised specialist in travel law and liability, brought her wealth of experience to the table—providing clarity on emerging legal challenges, regulatory developments, and practical guidance for operators and travel providers.

Key Takeaways from Claire’s Session:

1. Ongoing Impact of the Package Travel Regulations (PTR):

Claire discussed the current status of the Package Travel and Linked Travel Arrangements Regulations (2018), including how regulators are interpreting key areas such as significant changes, cancellations, and refunds. She highlighted recent cases that have shaped the enforcement landscape and provided valuable advice on contract wording and consumer communication.

2. Evolving Duty of Care and Health & Safety Expectations:

With travellers increasingly prioritising safety and hygiene in a post-pandemic world, Claire emphasised the growing expectations on operators to demonstrate clear due diligence in health and safety assessments. She reinforced the value of working with accredited safety partners to mitigate risk, noting that documentation and audit trails are more important than ever.

3. Litigation Trends and Claims Management:

Claire provided an overview of recent trends in claims—particularly those related to illness, personal injury, and accessibility. She advised companies to ensure that incident response protocols are robust and that staff are adequately trained to handle complaints on the ground.

We are extremely grateful to Claire Mulligan for her insightful presentation and for offering such a clear and practical lens on complex regulatory matters. Her session sparked meaningful discussion among attendees and reaffirmed the need for proactive legal readiness across the sector.
